1. General Provisions

These terms apply to all purchases made in the online store SailingAid.com and are prepared in accordance with Estonian and European Union legislation.
By placing an order, the customer confirms that they have read and agree to these Terms and Conditions.
2. Definitions
Consumer – a natural person purchasing goods for purposes not related to economic or professional activity.
Business Customer – a legal entity or entrepreneur purchasing goods in the course of business.
3. Product Information and Availability
Product descriptions and images are provided for informational purposes. Minor differences in appearance or technical characteristics may occur.
Product availability depends on stock. If a product becomes unavailable after an order is placed, the seller shall inform the customer as soon as possible and offer an alternative, waiting period, or cancellation with refund.
4. Placing an Order
Orders can be placed either with or without registering an account.
An automatically generated order confirmation e-mail does not constitute acceptance of the order.
5. Formation of Contract
The sales contract is concluded only after successful payment authorization or receipt of payment by the seller.
6. Seller’s Right to Refuse or Cancel Orders
The seller reserves the right to cancel or refuse an order in case of pricing errors, technical errors, stock discrepancies, damaged goods, suspected fraud, force majeure, or other circumstances preventing proper fulfilment.
If payment has already been received, it will be refunded without undue delay.
7. Prices and VAT
All prices are in euros (EUR) and include VAT unless otherwise stated.
If the customer is a taxable person established in another EU Member State and provides a valid VAT number verified through the VIES system, VAT may be applied at 0% in accordance with EU VAT rules.
The VAT number must belong to the customer placing the order. The seller reserves the right to refuse 0% VAT application if verification fails.
8. Payment
Available payment methods are displayed during checkout.
Orders are processed only after payment has been successfully received or authorized.
9. Delivery
Goods are delivered to standard street addresses within the European Union according to the selected delivery method.
Delivery to PO boxes, offshore locations, or marina docks is not provided.
The seller does not deliver to the Russian Federation, Belarus, or Ukraine.
Delivery times are indicative and depend on the destination and shipping method. In exceptional cases, delivery may take up to 45 calendar days.
10. Transfer of Risk
For Consumers, the risk of loss or damage passes to the customer upon physical receipt of the goods.
For Business Customers, the risk passes to the customer upon handover of the goods to the carrier.
11. Right of Withdrawal (Consumers Only)
A Consumer has the right to withdraw from the purchase within 14 days from receipt of the goods by notifying the seller in writing.
The goods must be returned within 14 days from submitting the withdrawal notice.
The Consumer bears the direct cost of return.
The returned goods must not be used beyond what is necessary to examine their nature, characteristics, and functioning. The Consumer is responsible for any decrease in value resulting from excessive use.
The right of withdrawal does not apply to custom-made or personalized goods, sealed goods not suitable for return due to health or safety reasons if unsealed, or goods which by their nature cannot be returned for hygiene or safety reasons.
12. Refunds
Refunds are made within 14 days from receiving the withdrawal notice, but not before the returned goods have reached the seller or proof of return has been provided.
13. Returns by Business Customers
Business Customers do not have a statutory right of withdrawal.
Returns by Business Customers are subject to agreement with the seller.
14. Warranty and Complaints
The seller is liable for non-conformity of goods in accordance with applicable law.
Consumers may submit complaints within 2 years from receiving the goods.
Manufacturer warranties, where applicable, are separate from statutory rights.
The warranty does not cover normal wear and tear, improper installation, improper maintenance, misuse, damage caused by external factors, or corrosion resulting from improper care.
15. Product Compatibility and Advice Disclaimer
The customer is responsible for verifying product compatibility with their vessel or equipment before purchase.
Any advice provided by the seller is informational and does not constitute a guarantee of suitability unless explicitly agreed in writing.
16. Limitation of Liability
The seller is not liable for indirect or consequential damages, including loss of profit or business interruption, except where mandatory law provides otherwise.
For Business Customers, the seller’s total liability is limited to the purchase price of the goods.
17. Intellectual Property
All content on the website is protected by intellectual property laws. Unauthorized reproduction, scraping, or commercial use is prohibited.
18. Acceptable Use
The website may not be used for unlawful purposes, fraudulent activities, automated data extraction, or actions that interfere with its normal operation.
19. Force Majeure
The seller is not liable for delays or failure to perform obligations caused by circumstances beyond reasonable control.
20. Personal Data Processing
Personal data is processed in accordance with the Privacy Policy available on the website.
21. Dispute Resolution
Estonian law applies.
Consumers: Disputes shall first be resolved through negotiations. If no agreement is reached, the Consumer may submit a complaint to the Consumer Disputes Committee operating under the Consumer Protection and Technical Regulatory Authority or file a claim with the competent Estonian county court.
Business Customers: Disputes shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in the competent Estonian county court. By mutual agreement, disputes may also be resolved at the Arbitration Court of the Estonian Chamber of Commerce and Industry.
